Ethics & Code of Conduct

India Realtors is dedicated to upholding the highest ethical and legal standards and is proud of its reputation for honesty and morality. These key values, to which we are dedicated, are essential to the success of the company. In order to always enforce and maintain the highest level of ethical and legal standards in all of our business efforts and in pursuing our company goals, it is essential to our principles and values.

Even while the code of ethics creates obligations that may be higher than those required by law, in any situation where they clash, the legal requirements must be followed.

Preamble

The land is underneath everything. The continuation and development of free institutions and our civilization are dependent upon its smart use and broadly distributed ownership. India Realtors should understand that the highest and best use of the property and the broadest distribution of land ownership are required to serve the interests of the country and its people. They call for the construction of livable cities, the growth of prosperous enterprises and farms, the maintenance of a wholesome environment, and the provision of suitable housing.

These obligations go above and beyond those of regular commerce. They place a heavy burden on India Realtors’ commitment to civic duty and social responsibility, for which we work hard to prepare. As a result, we are driven to uphold and raise the bar for their profession, and we share with their fellow Realtors® a duty for its integrity and honor.

India Realtors continuously strive to become and remain informed on issues affecting real estate and knowledgeable professionals, they willingly share the fruit of their experience and study with others. This is done out of recognition and appreciation for their obligations to clients, customers, the public, and each other. They recognize these behaviors and take action to stop them by enforcing this Code of Ethics and working with the relevant regulatory organizations. These actions could harm the public or bring the real estate profession into disrepute. Realtors in India who have firsthand knowledge of behavior that might be in violation of the Code of Ethics—such as the theft of client or customer funds or property, willful discrimination, or fraud causing significant financial harm—should bring it to the attention of the relevant local Real Estate Association, to which they are currently members in good standing.

Realizing that working together with other real estate professionals serves the interests of those who hire them, India Realtors must encourage exclusive client representation, abstain from trying to outdo their rivals, and avoid speaking ill of other practitioners without permission. When asked for their opinion or when India Realtors feels that it is important, they provide it objectively and professionally, free from any personal motives or prospective advantages or gains.

India As a result of commitment to a high ideal of moral conduct in business relationships, the term “real estate agent” has come to be associated with competence, fairness, and high integrity. No economic motive or customer directive can ever be used to excuse deviation from this standard.

India Realtors believe that the Golden Rule—”Whatever you would have others do to you, do likewise to them”—is the best model for how to understand this commitment. It has been passed down through the ages.

India Realtors undertakes to uphold this standard in all of its endeavors and to run its operations in accordance with the principles outlined below after accepting it as its own.

Value 1

India Realtors promises to uphold and advance the interests of its clients whether acting as an agent on behalf of a buyer, seller, landlord, tenant, or other client. Although this duty to the client comes first, India Realtors is still under a duty to treat everyone fairly. Pinnacle Realty shall uphold its obligation to treat all parties fairly even when servicing a buyer, seller, landlord, renter, or other person in a non-agency position.

India Realtors must refrain from embellishing, misrepresenting, or hiding material information pertaining to the property or the transaction. India Realtors are not required to find hidden flaws in the property, to offer advice on issues outside the purview of their real estate expertise, or to divulge information that falls under the purview of their agency agreement, if any.

With the exception of situations where cooperation is not in the clients’ best interests, India Realtors must work with other brokers. The need to cooperate does not entail the obligation to pay another broker in any other way, such as by splitting commissions or fees. Before examining any property offered by another broker, a fee sharing deal must be reached.

India realtors are prohibited from acquiring an interest in, purchasing, or making offers on, any real property without disclosing to the owner or the owner’s broker their true position, nor may they do so on behalf of themselves, any member of their immediate families, their firms or any member thereof, or any entities in which they have any ownership interest. India Realtors are required to disclose in writing to the buyer or the buyer’s agent their ownership or interest in any property they are selling.

India Realtors are prohibited from offering their professional services in relation to a property or its value when they have a present or future interest unless they explicitly disclose this interest to all parties involved.

Without the knowledge and approval of their clients, India Realtors are not permitted to receive any commission, rebate, or profit on purchases made for their clients.

In any transaction, India Realtors is not permitted to provide a discount on the statutory brokerage charge or to provide the buyer a pass back on the brokerage they paid to developers. To get clients, India Realtors must constantly uphold its basic value of ethics and never undercut its own brokerage or provide unfair advantages to clients of rival brokers. India Realtors must always act in the best interests of the entire real estate agent community and will never accept clients who do not adhere to the moral standards of the real estate industry.

India Realtors are required to hold all money received in trust for other people, such as escrows, trust funds, clients’ money, and other similar items, in a separate account from their personal assets at an acceptable financial institution.

In order to protect the interests of all parties, India Realtors will make every effort to ensure that contracts are in writing and express the precise terms, conditions, obligations, and commitments of the parties. Upon signing or initialing, each party shall receive a copy of each agreement.

Any person may receive equivalent professional services from India Realtors without regard to their race, color, religion, sex, ability, familial position, or country of origin. India Realtors are not allowed to be a part of any scheme or agreement that would discriminate against someone or something based on their race, color, religion, sex, ability, familial position, or country of origin.

Specifically, residential real estate brokerage, real property management, commercial and industrial real estate brokerage, real estate appraisal, real estate counselling, expat relocation, real estate syndication, real estate auction, and international real estate shall all be covered by the standards of practice and competence that India Realtors provide to their clients and customers.

India Realtors are prohibited from offering specialized professional services related to a type of property or service that falls outside their area of expertise unless they enlist the help of a person who is knowledgeable about such properties or services or unless all relevant information is fully disclosed to the client. Any individuals hired to provide such help must disclose their involvement in the assignment to the customer and identify themselves.

Realtors in India must always take care to give the public a true picture in their advertising and marketing. India Realtors must also make sure that any such advertising makes it clear what their actual status is or what their professional standing is (such as Agent, REALTOR®, property manager, etc.).

India Realtors are prohibited from engaging in actions that amount to the illegal practise of law and are required to advise clients to seek legal representation where doing so is in their best interests or the interests of any party to the transaction.

Value 15

India Realtors shall present all relevant facts before the appropriate tribunals of the Member Board of Association or affiliated institute, RERA Authorities, society or any council in which membership is held if charged with unethical practice or asked to present evidence or to cooperate in any other way in any professional standards proceeding or investigation, and shall not take any action to disrupt or obstruct such processes.

Realtors in India are forbidden from making untrue or deceptive claims about rivals, their companies, or their business practices.

India Realtors must refrain from engaging in any behavior that conflicts with the agency or other legally recognized exclusive connection that they have with their clients.
